Minutes of Town Meeting
President John P. Griffin, Sr. called the meeting to order at 7:10 p.m. Present were Town Commissioners Charles M. Rhodes, Jr. and Edward C. Raffetto, Jr., via telephone and Town Administrator/Clerk, Nancy J. Lindyberg. He dispensed with the Pledge of Allegiance. The minutes of February 4, 2019 were approved as submitted.
March 4, 2019
Animal Control Ordinance: Commissioner Rhodes stated that he has had the opportunity to speak with a few municipalities regarding their animal control ordinance. Commissioner Raffetto reminded the meeting that we should arrange a workshop for this legislation. The Commissioners are still doing research on this matter.
Planning & Zoning: Janet Rochester said that there was no February meeting and the next meeting will be Monday, March 11, 2019.
Board of Appeals: Nothing to report
Budget Status Report: Each Commissioner has a copy.
Tax Set-Off: The Town of Church Hill is scheduled to meet with the County Commissioners on Thursday, March 14, 2019 at 4:15 p.m. There will also be a meeting with the County Commissioners on Tuesday, March 26, 2019 at 6:30 p.m. Commissioner Rhodes stated that the Tax Set-Off will be the topic at the Council of Governments meeting on Wednesday, March 13, 2019.
Correspondence: The Town received an email from MML informing municipalities that the Small Cell Hearings have concluded.
United Methodist Church - Pastor Shane Moran: Pastor Shane Moran submitted a proposal to the Town Commissioners regarding the renting of the space at 324 Main Street formerly used as the Church Hill Town Office. He detailed that the space would be used as a thrift store to benefit the community. Commissioner Rhodes stated that the Church Hill Theatre has also expressed an interest in renting the space. The Commissioners are going to conduct more research and have some discussion regarding both requests.
B & K Plant Farm & Landscape LLC Estimate: Bill Price of B&K Plant Farm & Landscape, LLC submitted an estimate regarding the replacement of the fence around the sediment pond at Church Hill Crossing. He submitted two proposals: Proposal 1 is to remove the existing fence and wire, replace it with split rail fence wrapped with a 48" high 2x4 galvanized wire, with a metal gate. The price would be $4,525.00. Proposal 2 is to remove the existing fence and wire and replace it with a three board oak fence using treated post, wrapped with a 48" high 2x4 galvanized wire with a metal gate. The price would be $4,725.00. On both fences they would use concrete around the corner post and gate post, the wire fence would be nailed to the outside of the fence. Mr. Price recommended the oak three board fence which would be a stronger fence and easier to maintain. The Commissioners agreed to accept Mr. Price's recommendation. Commissioner Rhodes moved to accept Mr. Price's Proposal 2. Commissioner Raffetto seconded the motion. The motion passed 3-0.
Pursuant to the Annotated Code of Maryland, General Provisions Article, §3-305(b)(3) to "consider the acquisition of real property for a public purpose and matters directly related thereto"; Commissioner Rhodes moved to recess the regular meeting and enter into Closed session. Commissioner Raffetto seconded the motion. The regular meeting was recessed at 7:45 p.m.
Flow Reports: Each Commissioner had a copy of the report.
Smoke Test: The Town received an estimate from MES regarding smoke testing of the Town of Church Hill Sanitary Sewer Collection System, which is not to exceed $6,500.00. Commissioner Rhodes stated that because we have experienced a very heavy rainy season and he suggested to wait until after July 1, 2019 because in order for the test to be the most beneficial the ground has to be dry. Commissioner Raffetto expressed strong support for this idea. Commissioner Rhodes said that he would speak with MES regarding this matter.
Other: The Town received an email from Jay Jarrell of MES and requested that we contact our fuel company to check the fuel gauges on the fuel tanks at the Waste Water Treatment Plant because they did not seem to be working properly. Ms. Lindyberg contacted the fuel company and made the request. In a follow-up call she learned that the technicians will be on site to check the gauges on Thursday, March 7, 2019.
Comments: Mr. Karl Zierfuss expressed an interest in leasing/purchasing the small strip of grass between his parking lot and the Town Office building to pave the area in order to make more parking available. Commissioner Rhodes said they would make an appointment with Mr. Zierfuss to observe the area and further discuss his proposal for the area.
The Town Commissioners held a Closed Session at 7:45 p.m. and adjourned the Closed Session at 8:18 p.m. No action was taken and Commissioner Rhodes made a motion to return to regular session at 8:18 p.m. Commissioner Raffetto seconded the motion. The motion was passed 3-0.
As a result of discussion in the Closed Session, Commissioner Rhodes moved to contact the Town's attorney to develop a budget amendment in the form of a Town ordinance to move an additional $120,000.00 of unexpended reserve into the Sewer Fund to purchase the 9.95 acres adjacent to the sewer treatment plant for future sewer and water expansion. As well as move another $120,000.00 of unexpended reserve into the General Fund for the purchase of the Estate of Ross Rhodes, Sr. trailer park as possible site for new Town Office and Meeting Hall. The additional funds could also be used for repairs and maintenance. Commissioner Raffetto seconded the motion. The motion passed 3-0.
Commissioner Rhodes made a motion to adjourn the regular meeting. Commissioner Raffetto seconded the motion. The motion was passed 3-0. The meeting was adjourned at 8:28 p.m.
The next Town Meeting will be Monday, March 18, 2019 at 7:00 p.m.
